Logixkart Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at Ground Floor, H.No- 510, Fatehpur Beri, Delhi, India 110074 ("Company", "We", "Us", "Our" and terms of similar meaning) is the owner of the brand LiveShoppee and web based platform www.liveshoppee.com and mobile application 'LiveShoppee' (collectively, the "Platform"). The Company is committed to protecting your privacy. For the purposes of this Privacy Policy, the delivery partners, merchants and any user shall together hereinafter be referred to as ("You", "Your", "Yourself" or "User").
We value the trust You place in Us and recognize the importance of secure transactions and information privacy. This Privacy Policy describes how the Company will collect, use, share, protect or otherwise process your personal information through it’s Platform. We do not offer any product or service under this Platform outside India. Your personal information will primarily be stored and processed in India and may have data protection laws that are different from those that apply in the country in which you are located.
This Privacy Policy is an electronic record under the Information Technology Act, 2000 and the rules made thereunder. This Privacy Policy does not require any physical, electronic, or digital signature by Us and has been published in accordance with the provisions of the Information Technology Act, 2000 and the rules made thereunder that require publishing the privacy policy on the Platform.

This Privacy Policy does not apply to information that You supply to, or that is collected by, any third-party through the Platform, as well as any third-party websites that You visit or use in conjunction with the Platform's Services. Further, in case You are under the age of 18 years, You (i) accept and acknowledge that You are accessing the Platform through a parent or a legal guardian who is of a legal age to form a binding contract under the Indian Contract Act, 1872 and such person has accepted this Privacy Policy on Your behalf to bind You; and (ii) hereby acknowledge that You are accessing this Platform under the supervision of Your parent or legal guardian and have their express permission to use the Services.

By visiting the Platform or setting up/creating an user account ("Account") on the Platform, You accept and agree to be bound by the terms and conditions of this Privacy Policy and consent to Us collecting, storing, processing, transferring and sharing information including Your Personal Information (defined below) in accordance with this Privacy Policy. If You do not agree to the Privacy Policy, please do not use or access the Platform.
Collection of Information : We collect various information from You when You access or visit the Platform, register or set up an Account on the Platform or use the Platform. You may browse certain sections of the Platform and the Content, without registering an Account on the Platform. However, to avail certain Services on the Platform, You are required to set up an Account on the Platform. This Privacy Policy applies to information(s), as mentioned below and collected about You:
Personal Information: We may collect the following kinds of information from You (as appropriate) in order to deliver Our entire range of Services, including but not limited to: Your name, gender, email address, mobile and/or telephone numbers, service address, date of birth, picture(s), call recordings, contact details of people You refer to Us and other information about the service address that You give us, information provided by You while initiating and running a task, including, without limitation: search words, location, products or services being sought, reviews, rating, order details and history, pictures of items ordered or for which a task is run and all chat history, etc. We may ask You for certain financial information, including credit card account data or other payment method data, to process payments for some of Our Services. We currently do not store any financial information provided to Us. If you sign up as a merchant or delivery partner, We may also collect location details, copies of PAN, GST Number, Government issued identification documents, statutory registrations, other Know Your Customer (KYC) details, call and SMS details.
Additionally, if You are a delivery partner, We may also collect certain health related declarations (including body temperature, symptoms such as fever, cough, cold, vaccination status information and other health conditions). We may also collect the information for a third party as provided by You pursuant to a referral program on the Platform (such as name, contact details, etc). We may also ask You to provide any other personal information which You give us in connection while booking a service or is relevant to customer surveys and/or offers available on the Platform.
We have enabled features, which require Our access to Your address book, calendar, camera, photo gallery etc. In addition to voice calling, we have enabled a "Video Call" feature in our App. The customer can connect through video call with our delivery partner to see the products ordered by the user from the relevant store. However, the delivery partner cannot view or see the said customer. There is also no Video Call functionality provided to the Delivery Partner to protect the privacy of the customer and therefore the Delivery Partner cannot contact the user via Video Call and this function is exclusively available to the customer. It is only available to User(s) that utilise Our Services. We may store video call recordings for internal security and research purposes in order to improve Our Services based on current user patterns.
Sensitive Personal Information: For the purpose of this Privacy Policy, Sensitive Personal Information consists of information relating to the following:
passwords;
financial information such as bank account or credit card or debit card or other payment instrument details;
physical, physiological and mental health condition;
sexual orientation;
medical records and history;
biometric information;
any details relating to the above as provided to a body corporate for providing services; and
any details relating to the above, received by a body corporate for processing, stored or processed under lawful contract or otherwise.
any other information that may be regarded as “Sensitive Personal Information” as per the prevailing law for the time being in force.

Device: When and if You download and/or use Our Platform through Your device, We may receive information about Your location and Your device, including a unique identifier number for Your device, device model, operating systems, versions, software, file names, advertisement identifiers and mobile network information. We may use this information to provide You with location-based Services including but not limited to search results and other personalized content. When You use the Platform through the telecommunication device, we collect Your location data. If You permit the Platform to access Your location through the permission system used by Your mobile operating system, We may also collect the precise location of Your device when the App is running in the foreground or background. We may also derive Your approximate location from Your IP address.
You can withdraw Your consent at any time by disabling the location tracking functions on Your device. However, this may affect Your experience of certain functionalities on the Platform. In addition to the above, Your IP address is identified and used to also help diagnose problems with Our server, resolve such problems and administer the Platform. User communication: When You send emails or other communications to Us, We may retain those communications in order to process Your inquiries, respond to Your requests and improve Our Services.
Other Parties: We may collect, process and store your user ID associated with any social media account (such as your Facebook and Google account) that you use to sign into the Services or connect with or use with the Services. If You are a merchant, delivery partner, We may, additionally record your calls with Us for the Services provided using the Platform, SMS details, receive feedback and rating from other users.
You can browse the Platform without telling Us who You are or revealing any Personal Information about Yourself. On receiving personal information about our users, You no longer remain anonymous to Us. We may use this information to do internal research on our demographics, interests, and behaviour to better understand, protect and serve You better. This information is compiled and analysed on an aggregated basis and in a manner that does not personally identify You. We indicate fields that are mandatorily required to be filled and fields that are optional. You may decide whether or not to provide such information to Us.
We will collect and store any information You provide to Us if You choose to post messages on the Platform's message boards, chat rooms, or other message areas, or if You leave feedback. We keep this information as long as it is required to settle disputes, provide customer support, address queries, and inquiries, troubleshoot problems, and improve the Services.
If You send us correspondence, such as emails or letters, about Your activities or postings on the Platform, or if other users or third parties send us correspondence about Your activities or postings on the Platform, We may collect and retain such information in a file specific to You for responding to Your request and addressing concerns about Your use of the Platform.
You may choose not to provide us with any Personal Information or information as required to complete your tasks/transactions initiated on Your Platform. If We do not receive information required for Your tasks, a delivery partner or Merchant may choose not to complete Your task/transaction initiated on the Platform.
Additional Information :When You use Our Services, We may collect information about You, with Your permission, in the following general categories:
Address Book: For certain features, We will need access to Your address book on Your device. If You permit Us to access Your address book, We may access and store names and contact information from Your address book to facilitate certain service features on the App.
Transaction information: We collect transaction details related to Your use of Our Platform, including the type of service requested, date and time when the service was provided, transaction status, order history, number of transactions, amount charged, and other related transaction details. Further, We may also collect personal information of third parties who are not registered on the Platform, including names, telephone numbers and addresses, for the limited purpose of completing the transaction initiated by You on the Platform. All transactional information gathered by Us shall be stored on servers, log files and any other storage system owned by any of Us or by third parties.
Use of Personal Information :
We shall be entitled to retain the information collected by Us through our Platform and use it inter alia for the following purposes:

Additionally, the Company may request that You complete optional online surveys. These surveys may request contact and demographic information from You (like pin code, or age). We use this information to customize, develop and improve Your experience on the Platform by showing You content that We believe You might be interested in and displaying content based on Your preferences. We may use Your information to send You promotional emails; however, You will have the option to opt-out of receiving such emails from Us. You cannot, however, choose not to receive administrative messages, customer service responses, or other transactional communications. We will not share Your Personal Information with another Platform user without Your express permission.
We may use personal information to resolve disputes that may arise with the use of Our services on the Platform, help promote a safe Service to You on the Platform, measure consumer interest in Our services, customize Your experience, detect and protect Us against error, fraud and other illegal activity, enforce Our terms and conditions.
We identify and use Your IP address to help diagnose problems with our server, and to administer our Platform. Your IP address is also used to help identify You and to gather broad demographic information.

For the purpose of this clause the term “Group” shall mean, with respect to any person, any entity that is controlled by such person, or any entity that controls such person, or any entity that is under common control with such person, whether directly or indirectly, including any Relative or Related Party (as such term defined in the Companies Act, 2013 to the extent applicable) of such person, holding, subsidiary Companies, etc.
Any content or personal information that You share or upload on any current or future publicly viewable portion of the Platform (on discussion boards, in messages and chat areas, etc.) will be publicly available, and can be viewed by others.
If You provide a mobile phone number and/or e-mail address, the Company, or other parties registered on the Platform may call You or send You communications in relation to Your use of the Platform or Your any transaction initiated by You on the Platform. We and our affiliates will share/transfer some or all of the collected information (Personal, Sensitive Personal or otherwise) with another business entity should We (or our assets) plan to merge with, or be acquired by that business entity, or reorganization, amalgamation, joint ventures, restructuring of business, in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding. Should such a transaction occur, that other business entity (or the new combined entity) will be contractually bound to comply with the terms of this Privacy Policy.
Transaparency and Choice :

If You exercise Your right to withdraw Your consent, You accept and agree that:
You will lose access to Your account information, saved addresses, transaction and search history; and
You will no longer be able to undertake any transaction on the Platform or access the Service available on the Platform for which the said information was sought on the Platform.
Please note that You may not withdraw Your consent, until:
You are a part of any on-going transaction on the Platform; and/or
Have a pending payment for a completed transaction on the Platform; and/or
Have an open support channel for any transaction (whether ongoing or completed).
Further, You acknowledge and agree that in case of such withdrawal of Your consent, the Company reserves the right to store Your information in an anonymized form such that the information stored will not be attributable to you or identify You in any manner whatsoever. The Company shall complete the anonymizing the data within 30 days from the date of withdrawal of consent. Further, the Company may also store certain information provided by You, or collected in process of Your use of the Platform, as may be required under applicable laws.
Information Safety : All information is saved and stored on Amazon Web Services, which may store this data on their servers outside India. Amazon Web Services has security measures in place to protect the loss, misuse and alteration of the information, details of which are available at https://aws.amazon.com/. Once Your information is in Our possession We adhere to strict security guidelines, protecting it against unauthorized access. The Company shall take reasonable steps to help protect Your rights of privacy and Your information (personal or otherwise) in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, or destruction of such information, in compliance with the applicable laws. You expressly consent to the sharing of Your information with third party service providers, including vendors, merchants, insurance agents and insurers, promotion and marketing partners, consultants, research firms, business partners, financial service providers, payment gateways, to process payments and manage payment card information. Company does not itself store Your payment card account information, and does not have direct control over or responsibility for Your payment card account information. Hence, Company cannot guarantee that transmissions of Your payment card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by Company or Company’s third-party service providers. Company assumes no liability or responsibility for disclosure of Your information due to any reason, including but not limited to errors in transmission, unauthorized third-party access, or other causes beyond its control. Although we shall try our best to protect Your data we cannot take any guarantee for the security of Your data transmitted through the Platform.
You play an important role in keeping Your personal information secure. You will be responsible for maintaining the confidentiality of the Account information and are fully responsible for all activities that occur under Your Account. You agree to (a) immediately notify Us of any unauthorized use of Your Account information or any other breach of security, and (b) ensure that You exit from Your Account at the end of each session. We cannot and will not be liable for any loss or damage arising from Your failure to comply with this provision. You will be held liable for any losses incurred by any other user or visitor on the Platform due to authorized or unauthorized use of Your account as a result of Your failure in keeping Your account information secure and confidential. You shall not share Your user name, password, or other security information for Your account with anyone. We have undertaken reasonable measures to protect Your rights of privacy with respect to Your usage of thePlatform and the Services. However, We shall not be liable for any unauthorized or unlawful disclosures of Your Personal Information made by any third parties who are not subject to Our control.
Regardless of what is stated in this Privacy Policy or elsewhere, We will not be held liable for:
any security breaches on third-party websites or applications, or any actions taken by third-party recipients of Your Personal Information; or

Public Posts :If the Platform permits You, You may provide Your feedback, reviews, comments, etc. on the Platform on Your use of the Platform and/or in relation to any transactions on the Platform on any portion of the Platform that is publicly viewable (“Posts”). In such an event, (i) Your Posts shall have to comply with the conditions relating to Posts as mentioned in the applicable Terms of Use and applicable law; and (ii) the Company shall have an unconditional right to remove and delete any Post or such part of the Post that, in the sole opinion of the Company, does not comply with the conditions in the applicable Terms of Use or applicable law. All Posts shall be publicly accessible and visible to all Users of the Platform. All intellectual property rights in and to such Posts shall vest with Us. Company reserves the right to use, reproduce and share such Posts for any purpose at its discretion. If You delete Your Posts from the Platform, copies of such Posts may remain viewable in archived pages, or such Posts may have been copied or stored by other Users.
Retention of Your Personal Information :We maintain records of Your Personal Information only till such time it is required for the Purposes, or for as long as required by applicable law. When You request us to delete Your information, we will honour the said request, but we may retain certain information about you for the purposes authorized under this Privacy Policy unless prohibited by law.

We will be unable to provide You with access to the Platform or the Services if You choose to update or modify Your Personal Information in a way that is not verifiable by Us or results in such information being incorrect. We reserve the right to verify and authenticate Your identity and Personal Information in order to provide You with Services and/or make the Platform available. We can only keep Your Personal Information up to date and accurate if You provide us with the required information. It is Your responsibility to notify Us if Your Personal Information changes. We may deny or limit access to or correction, updating, or deletion of Your Personal Information if doing so would violate the rights of another person and/or is not otherwise permitted by applicable law.
